What freezes? The whole computer or just the game?
If the computer is new these signs are sometimes normal (like with mine) but after a while they'll go away...my computer unfreezed after about 10-30secs. :)

Well it seems that when you got your Graphics Card it was already broken, but since it's so new I'm sure you'll get a replacement in no time.
is there any way i can actually see if its broken? so i know if i should call them.
Try running all sorts of programs that use 3D rendering i.e. more games.... If they all show similar symptoms then you can be 99.8% sure that your GFX Card is fried out of the box, so to speak...
wait... when i check out the specs of my comp it says the video memory is 256mb is that bad??
Actually the odds of a graphic card to be broken are VERY slim...the whole lock up could be caused by something else.
Did you build that rig yourself?
And no 256 MB are just fine.
